Already have an FFL and want to start dealing in suppressors, SBRs, and other NFA items? Adding SOT (Special Occupational Taxpayer) status to your existing license is a straightforward process that takes just 2-4 weeks. Here's everything you need to know about the upgrade process.
What You Need Before Applying
Before you can add SOT status, you must have a qualifying FFL already approved and in good standing:
For Class 3 SOT (Dealing)
- Type 01 FFL: Dealer in Firearms (most common)
- Type 02 FFL: Pawnbroker dealing in firearms
- Type 09 FFL: Dealer in destructive devices
For Class 2 SOT (Manufacturing)
- Type 07 FFL: Manufacturer of firearms
- Type 10 FFL: Manufacturer of destructive devices
For Class 1 SOT (Importing)
- Type 08 FFL: Importer of firearms
- Type 11 FFL: Importer of destructive devices
If you have a Type 03 FFL (Curio & Relic Collector), you cannot add SOT status. Type 03 is for personal collecting only, not dealing.
The Form 5630.7 Process
ATF Form 5630.7 (Special Tax Registration and Return) is your application to become a Special Occupational Taxpayer. Here's the step-by-step process:
Step 1: Download Form 5630.7
Get the current version from the ATF website. The form is relatively simple compared to your original FFL application.
Step 2: Complete the Form
You'll need to provide:
- Your FFL number
- Business name and address (must match FFL)
- SOT class you're applying for (1, 2, or 3)
- Tax year (July 1 - June 30)
- Payment information
Step 3: Calculate Your Tax Payment
The SOT tax depends on when you apply during the tax year:
| Application Month | Class 3 Cost | Class 1/2 Cost* |
|---|---|---|
| July - September | $500 | $1,000 |
| October - December | $375 | $750 |
| January - March | $250 | $500 |
| April - June | $125 | $250 |
*Class 1/2 cost is $500/$250/$125/$62.50 if gross receipts under $500,000
Step 4: Submit Form and Payment
Mail your completed Form 5630.7 with payment to the address specified on the form. Payment can be made by check, money order, or credit card (using Form 5630.7A).
Step 5: Wait for Approval
Processing typically takes 2-4 weeks. You'll receive confirmation of your SOT status in the mail.
No Additional Fingerprints Required
One of the most common questions about the SOT upgrade process: "Do I need new fingerprints?" The answer is no.
When you applied for your FFL (Form 7), you submitted fingerprints for all responsible persons. Those fingerprints were used for your FBI background check. Since the SOT registration is simply adding a tax status to your existing FFL, no additional background check is performed.
When You Will Need Fingerprints
While SOT registration doesn't require fingerprints, you'll still need fingerprints for:
- FFL renewal: When renewing your FFL every 3 years, new fingerprints are required
- Adding responsible persons: Any new RP added to your FFL needs fingerprints
- Customer Form 4s: When processing NFA transfers, your customers need fingerprints
What You Can Do After SOT Approval
Once your SOT status is approved, you can immediately begin NFA operations:
Class 3 SOT Privileges
- Form 3 transfers: Receive NFA items from manufacturers and distributors tax-free
- Hold NFA inventory: Keep suppressors, SBRs, SBSs, and AOWs in stock
- Form 4 transfers: Sell NFA items to qualified customers
- Transferable machine guns: Deal in pre-1986 machine guns
What Class 3 Cannot Do
- Manufacture NFA items (requires Class 2)
- Import NFA items (requires Class 1)
- Acquire post-sample machine guns
Setting Up Your NFA Operations
After receiving SOT approval, take these steps to begin operations:
1. Register for eForms
Create a dealer account on the ATF eForms system. This links to your FFL/SOT and allows you to:
- Initiate Form 4 transfers for customers
- Track pending applications
- Receive Form 3 transfers from distributors
2. Establish Distributor Relationships
Contact NFA distributors and manufacturers to set up dealer accounts:
- Silencer Shop
- Capitol Armory
- Direct manufacturer accounts (SilencerCo, Dead Air, etc.)
3. Prepare Customer Fingerprinting
Your customers will need fingerprints for their Form 4 submissions. Many dealers offer in-house fingerprinting as an additional service and revenue stream.
Offer Fingerprinting to Your Customers
Convert FD-258 cards to EFT format for customer eForms. SlapEFT makes it easy to provide fingerprinting services.
Learn MoreCommon Questions About the Upgrade Process
Can I apply for SOT before my FFL is approved?
No. You must have an approved FFL before submitting Form 5630.7. The SOT registration requires your FFL number.
What if my FFL is up for renewal soon?
Your SOT status is independent of your FFL renewal. However, if your FFL lapses, your SOT automatically terminates. Plan your SOT application timing accordingly.
Can I change SOT classes later?
Changing from Class 3 to Class 2 requires getting a different underlying FFL (Type 07 instead of Type 01). It's not a simple upgrade. However, you can add multiple FFL locations with different SOT classes if needed.
What if I apply in June?
Applying in April-June gives you the lowest prorated cost ($125 for Class 3), but you'll need to pay the full renewal by July 1. Strategic timing can save money on your first year.
Timeline Summary
| Step | Timeframe |
|---|---|
| Obtain qualifying FFL | 60-90 days (if not already held) |
| Prepare Form 5630.7 | 1-2 days |
| Mail application with payment | 1-3 days |
| ATF processing | 2-4 weeks |
| Set up eForms/distributors | 1-2 weeks |
| Total (with existing FFL) | 3-6 weeks |
Cost Summary
For a typical Type 01 FFL adding Class 3 SOT:
- Form 5630.7 (SOT tax): $125-$500 depending on timing
- No fingerprint costs: Already on file
- No photo costs: Already on file
- No additional fees: Just the SOT tax
Compare this to your original FFL application which required fingerprints, photos, and the $150 application fee plus the IOI interview and inspection.
