1. Acceptance of Terms
By accessing or using slapEFT ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and slapEFT ("we," "us," or "our").
We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.
2. Description of Service
slapEFT provides a digital conversion service that:
- Accepts uploaded images of completed FD-258 fingerprint cards
- Extracts and processes fingerprint images
- Generates EFT (Electronic Fingerprint Transmission) files in ANSI/NIST-ITL format
- Delivers EFT files suitable for upload to ATF eForms
What We Are Not: A fingerprinting service, legal advisor, or government agency.
We do not collect your fingerprints. You provide already-completed fingerprint cards which you obtained elsewhere (law enforcement, UPS, self-inking, etc.).
3. Eligibility
To use the Service, you must:
- Be at least 18 years of age
- Be legally permitted to possess NFA items in your jurisdiction
- Have legal authority to submit fingerprints for the person whose prints are on the card
- Not be prohibited from receiving services from a US-based company
By using the Service, you represent and warrant that you meet all eligibility requirements.
4. Acceptable Use
You agree to use the Service only for lawful purposes. Acceptable uses include:
- Converting your own fingerprint cards for ATF eForm submission
- Converting fingerprint cards for family members with their consent
- Converting fingerprint cards for NFA trust beneficiaries you represent
- Converting fingerprint cards for customers if you operate a gun shop (Shop Queue feature)
Your Responsibilities
- Ensure all information entered is accurate and truthful
- Obtain proper consent before uploading anyone else's fingerprints
- Maintain the security of your access codes
- Download and backup your EFT files within the retention period
5. Prohibited Activities
You may NOT use the Service to:
- Upload fingerprints of any person without their knowledge and consent
- Submit false or fraudulent information
- Attempt to circumvent payment or access controls
- Reverse engineer, decompile, or attempt to extract source code
- Probe, scan, or test vulnerabilities of the Service
- Interfere with or disrupt the Service or servers
- Use automated systems (bots, scrapers) without permission
- Resell the Service without authorization
- Violate any applicable law or regulation
6. Payment & Pricing
Pricing
- Standard conversion: $10 per FD-258 card
- Volume discounts may apply for multiple conversions
- Prices are in US dollars and subject to change
Payment Methods
We accept cryptocurrency payments via Bitcoin Lightning Network. We do not accept credit cards.
Payment Terms
- Payment is due before EFT file download is enabled
- All payments are final upon completion
- You may preview your detected fingerprints before payment
7. Refunds
Due to the digital nature of our product and the sensitive data involved:
Refunds ARE available if:
- Technical failure prevents generation of a valid EFT file
- The generated file is rejected by ATF eForms due to our error
- You paid but were unable to download your file due to our system failure
Refunds are NOT available if:
- You successfully downloaded your EFT file
- Your fingerprints were of poor quality (not our error)
- ATF rejects your application for reasons unrelated to the EFT file format
- You changed your mind after payment
- You provided incorrect demographic information
To request a refund, contact support@slapeft.com with your access code and a description of the issue.
8. Intellectual Property
Our Property
The Service, including its design, code, features, and documentation, is owned by slapEFT and protected by copyright, trademark, and other intellectual property laws.
Your Content
You retain ownership of your fingerprint images and personal information. By uploading content, you grant us a limited license to process it solely for providing the Service.
Output Files
The EFT files generated are yours to use as intended (ATF submission). The file format (ANSI/NIST-ITL) is a public standard.
9. Disclaimer of Warranties
We specifically disclaim:
- Any warranty that the Service will meet your specific requirements
- Any warranty that the Service will be uninterrupted, timely, secure, or error-free
- Any warranty regarding the accuracy of fingerprint detection
- Any warranty that ATF will accept your generated EFT file
- Any warranty that your NFA application will be approved
Government Acceptance
We generate EFT files that comply with the ANSI/NIST-ITL standard used by ATF eForms. However, we cannot guarantee acceptance by any government agency. Acceptance depends on factors outside our control, including:
- Quality of your original fingerprints
- Accuracy of information you provided
- Changes to government requirements
- Technical issues on the government's end
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- slapEFT shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- slapEFT shall not be liable for any loss of profits, data, use, goodwill, or other intangible losses
- Our total liability for any claim arising from the Service shall not exceed the amount you paid for the specific transaction at issue
These limitations apply regardless of the theory of liability (contract, tort, strict liability, or otherwise).
Specific Exclusions
We are not liable for:
- Delays in ATF processing of your application
- Denial of your NFA application for any reason
- Loss of business or opportunity due to processing delays
- Actions taken by government agencies
- Your failure to download files before automatic deletion
11. Indemnification
You agree to indemnify, defend, and hold harmless slapEFT and its operators from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third party's rights
- Your violation of any applicable law
- Any content you upload to the Service
- Any misrepresentation you make
12. Termination
By You
You may stop using the Service at any time. Any unused paid services are non-refundable upon voluntary termination.
By Us
We may suspend or terminate your access to the Service immediately, without notice, if:
- You violate these Terms
- We suspect fraudulent, abusive, or illegal activity
- Required by law or government request
- The Service is discontinued
Effect of Termination
Upon termination, your right to use the Service ceases immediately. We may delete your data. Provisions that by their nature should survive (limitations of liability, indemnification, dispute resolution) will survive termination.
13. Dispute Resolution
Informal Resolution
Before filing any formal dispute, you agree to contact us at support@slapeft.com and attempt to resolve the dispute informally for at least 30 days.
Binding Arbitration
Any dispute not resolved informally shall be resolved by binding arbitration under the rules of the American Arbitration Association. The arbitration shall be conducted in English, and judgment on the award may be entered in any court of competent jurisdiction.
Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
Exceptions
Either party may bring claims in small claims court if eligible. Either party may seek injunctive relief in any court of competent jurisdiction for infringement of intellectual property rights.
Governing Law
These Terms shall be governed by the laws of the State of Florida, without regard to conflict of law principles.
14. General Provisions
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and slapEFT regarding the Service.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
Waiver
Failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
Assignment
You may not assign your rights under these Terms. We may assign our rights to any successor or affiliate.
Force Majeure
We shall not be liable for any failure or delay due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, government actions, or internet outages.
No Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights.
