How to Become a Class 3 SOT Dealer

Step 1: Obtain Your FFL
Apply for FFL Type 01 (Dealer), Type 02 (Pawnbroker), or Type 09 (Dealer/Non-destructive devices). Submit Form 7 with fingerprints for all responsible persons. Processing takes 60-90 days.

Step 2: Register as SOT
Once your FFL is approved, submit ATF Form 5630.7 (Special Tax Registration and Return) with the $500 annual tax. No additional fingerprints required at this stage.

Step 3: Begin NFA Operations
After SOT approval, you can acquire NFA items via Form 3 (tax-free from other SOTs) and sell to customers via Form 4. Consider offering fingerprinting services as an add-on revenue stream.

Do Class 3 SOT dealers need fingerprints?
Yes, but indirectly. To become a Class 3 SOT, you must first have an FFL (Type 01, 02, or 09), which requires fingerprints for all responsible persons on Form 7. The SOT application itself (Form 5630.7) does not require additional fingerprints since your background was already verified through the FFL process.
What's the difference between Class 1, Class 2, and Class 3 SOT?
Class 1 SOT is for importers of NFA items (requires FFL Type 08 or 11). Class 2 SOT is for manufacturers of NFA items (requires FFL Type 07 or 10). Class 3 SOT is for dealers of NFA items (requires FFL Type 01, 02, or 09). Class 3 is the most common for retail suppressor and SBR sales.
Can I be an SOT dealer from home?
Yes, home-based SOT dealers (sometimes called "kitchen table SOTs") exist. You need an FFL first (which can be home-based), then add SOT status. Check local zoning laws and state regulations. Many successful NFA dealers operate from home.
What happens to my NFA inventory if I lose SOT status?
If you discontinue your SOT (voluntarily or involuntarily), you have options for your inventory: transfer items to another SOT via Form 3, sell to qualified individual buyers via Form 4 (they pay transfer tax), or register items to yourself personally (you pay tax). Important: Post-sample machine guns cannot be kept personally and must be transferred to another SOT, surrendered to ATF, or destroyed.
How much does SOT status cost annually?
Class 3 SOT (dealers) pay $500/year. Class 1 and 2 SOTs pay $1,000/year (or $500 if gross receipts are under $500,000). The SOT tax year runs July 1 - June 30, regardless of when you apply. Mid-year applicants get prorated tax.
