New York has banned most NFA items for civilian ownership. ALL NFA items banned. SAFE Act. NYC has additional extreme restrictions. Class D felony.
What's Banned
- Suppressors/Silencers: Completely banned. No exceptions for civilians.
- Short-Barreled Rifles (SBRs): Prohibited for civilian ownership.
- Short-Barreled Shotguns (SBSs): Prohibited for civilian ownership.
- Machine Guns: Banned with very limited exceptions.
Federal Changes Don't Help
The 2026 federal elimination of the $200 NFA tax stamp has no effect on New York law. New York's ban is a state law that operates independently of federal regulations.

Do I need a special permit for NFA items in New York?
No, New York does not require any special state permits beyond the federal ATF requirements. You only need to complete the standard ATF Form 4 process, which includes fingerprints (FD-258), passport photos, and a background check.
Can I hunt with a suppressor in New York?
No, hunting with suppressors is not allowed in New York.
Can I travel with my NFA items to other states?
Suppressors can travel freely to any of the 42 states where they're legal—no ATF notification required. However, SBRs, SBSs, and machine guns require ATF Form 5320.20 approval before crossing state lines. Never take any NFA item to a state where it's prohibited.
