New York heavily restricts NFA items. Most suppressors, SBRs, and similar items are banned. Here's what NY residents need to know.
New York NFA Item Status
- ❌ Suppressors - BANNED for civilians
- ❌ Short Barreled Rifles (SBRs) - Effectively BANNED
- ❌ Short Barreled Shotguns (SBSs) - BANNED
- ⚠️ Machine Guns - Complex (pre-86 only, difficult)
- ⚠️ AOWs - Varies by configuration
The SAFE Act Impact
The NY SAFE Act (2013) added additional restrictions beyond prior laws:
- Expanded "assault weapon" definitions
- Registration requirements
- Magazine capacity limits
- Made SBR-type configurations extremely difficult
NYC vs Rest of NY
New York City has even more restrictions than state law:
- Handgun permits extremely difficult
- Long gun permits required
- Additional local prohibitions
Upstate NY is somewhat more permissive but still subject to state-level NFA bans.
Options for New York Residents
Option 1: Move to a Free State
Many NY residents have relocated to Pennsylvania, Vermont, New Hampshire, or other states with NFA access.
Option 2: Out-of-State Ownership
If you have dual residency in an NFA-friendly state, you may be able to own items there. Complex - consult an attorney.
Option 3: Enjoy Compliant Firearms
Focus on firearms that comply with NY law. "Featureless" builds exist.
