What is an SBR?
An SBR (Short Barreled Rifle) is a rifle with:
- Barrel length less than 16 inches, OR
- Overall length less than 26 inches
Common examples:
- AR-15 with 10.5" barrel and stock
- AK with short barrel and stock
- MP5 clone with stock
- PS90 with short barrel
Legal Requirements
Check Your State
SBRs are legal in most states but prohibited in some:
- Prohibited: CA, CT, HI, NJ, NY, RI, WA, DC
- Legal with restrictions: Some states have additional requirements
Federal Requirements
- File ATF Form 1 BEFORE building
- Pay tax stamp ($0 in 2026)
- Wait for approval
- Engrave before building
Critical: You cannot assemble an SBR before Form 1 approval. Having a rifle receiver + short barrel + stock in your possession before approval could be constructive possession of an illegal SBR.
Planning Your Build
Starting Points
Option 1: Convert Existing Pistol (Most Common)
Start with an AR pistol with brace, file Form 1, then add stock after approval.
- Pistol already has short barrel
- Just need to swap brace for stock
- Already have serialized receiver
Option 2: Convert Existing Rifle
Start with a rifle, file Form 1, then install short barrel after approval.
- Cut down existing barrel, OR
- Install new short barrel upper
Option 3: Build from Receiver
Start with stripped receiver, file Form 1, then build complete SBR.
- Most flexibility
- Receiver serial number goes on Form 1
What to Decide Before Filing
- Barrel length - Required on Form 1
- Overall length - Required on Form 1
- Caliber - Required on Form 1
- Make/Model - Of the receiver
- Serial number - From receiver
Filing ATF Form 1
What You Need
- ATF eForms account
- Receiver information (make, model, serial)
- Build specifications (barrel length, OAL, caliber)
- Passport-style photo
- Fingerprints in EFT format
- CLEO information
Form 1 Process
- Log into ATF eForms
- Select "Form 1 - Application to Make"
- Choose "Individual" or "Trust"
- Fill in applicant information
- Enter firearm details
- Upload photo and EFT fingerprints
- Enter CLEO information
- Review and certify
- Submit and pay tax
Wait Time
- eForms: 30-60 days typical
- Paper: 6-12 months (don't do this)
Engraving Requirements
After approval and BEFORE building, you must engrave the receiver.
Required Markings
- Your name (or trust name)
- City
- State
Technical Requirements
- Minimum depth: 0.003 inches
- Minimum character height: 1/16 inch
- On the receiver (frame)
- Conspicuous location
Common Locations
- AR-15: Magazine well, lower side
- AK: Receiver flat
- Inside of magwell (less visible but legal)
Getting It Done
- Local engraver ($30-75)
- Gun store with engraving service
- DIY with proper equipment
Building After Approval
Once you have:
- ✓ Approved Form 1
- ✓ Engraved receiver
You can legally assemble your SBR:
- Install short barrel (or upper with short barrel)
- Install stock
- Your rifle is now a registered SBR
Traveling with Your SBR
- Within your state: No notification required
- Interstate: File ATF Form 5320.20 (free, approved in days)
- Keep approved Form 1 with the firearm
